1. Acceptance of Terms

By accessing or using CreateOnce ("the Service"), operated at createonce.io, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and CreateOnce ("we," "us," or "our").

2. Description of Service

CreateOnce is an AI-powered content repurposing platform that allows users to submit text content and receive AI-generated versions optimized for various social media platforms and communication channels. The Service includes content transformation, voice profile customization, transformation history, and related features as described on our website.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. You must be at least 16 years old to create an account and use the Service.

4. Subscription and Payment

The Service offers both free and paid subscription plans. For paid plans:

• Subscriptions are processed through Polar.sh (via Stripe) and are billed on a recurring monthly or annual basis, depending on the plan you select.
• Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
• You may cancel your subscription at any time through the billing page or the Polar customer portal. Cancellation takes effect at the end of the current billing period, and you will retain access to paid features until that date.
• Refunds are handled on a case-by-case basis. Contact us at support@createonce.io for refund requests.
• We reserve the right to change subscription pricing with 30 days advance notice. Price changes do not affect active billing periods.
• Each plan includes a specific monthly limit of content transformations. Usage resets at the beginning of each billing cycle.

5. Acceptable Use

You agree not to use the Service to:

• Generate, distribute, or promote content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Produce spam, bulk unsolicited messages, or deceptive content
• Generate content that infringes on the intellectual property rights of others
• Create content that impersonates another person or entity
• Attempt to circumvent usage limits, security measures, or access controls
• Use automated scripts, bots, or scrapers to access the Service without authorization (except through our official API on eligible plans)
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use the Service in any way that could damage, disable, or impair its functionality
• Resell or redistribute the Service without our written consent

We reserve the right to suspend or terminate accounts that violate these acceptable use guidelines, with or without notice.

6. Intellectual Property

6.1 Your Content

You retain full ownership of all content you submit to the Service ("Input Content") and all AI-generated outputs produced from your Input Content ("Output Content"). We claim no ownership rights over your Input Content or Output Content. By using the Service, you grant us a limited, non-exclusive license to process your Input Content solely for the purpose of providing the Service.

6.2 Our Service

The Service, including its design, features, code, documentation, logos, and branding, is owned by CreateOnce and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

7. AI-Generated Content Disclaimer

Content generated by the Service is produced by artificial intelligence and may not always be accurate, complete, or appropriate for your intended use. You are solely responsible for reviewing, editing, and verifying all AI-generated content before publishing or distributing it. We do not guarantee the accuracy, quality, or suitability of any AI-generated output.

8. Service Availability

We strive to maintain the availability of the Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime in advance.

9. Limitation of Liability

To the maximum extent permitted by applicable law, CreateOnce and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability for any claims arising from these Terms or your use of the Service shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim. The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Indemnification

You agree to indemnify, defend, and hold harmless CreateOnce from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, your content, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may terminate your account at any time by contacting us at support@createonce.io. Sections of these Terms that by their nature should survive termination shall remain in effect, including but not limited to intellectual property provisions, limitation of liability, and indemnification.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree with any changes, you must stop using the Service.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CreateOnce operates, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved through good-faith negotiation, and if necessary, binding arbitration.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
